¿Por qué comprar una propiedad reposeída por el Banco?

Existe una percepción general de que las propiedades reposeídas, se pueden comprar únicamente mediante subasta pública, o sea cuando usted asiste a la subasta. Lo cierto es que para poder licitar y comprar una propiedad mediante una subasta, usted tiene que pagar en efectivo; o sea que debe llevar un cheque certificado por el precio de venta total de esa propiedad. Si usted es quien gana la subasta, usted recibe la propiedad “as is” (en la condición que está en la actualidad), y al resultar el ganador o el mejor postor de la subasta, usted además acepta la propiedad con otras cargas y gravámenes tales como deudas en contribuciones sobre la propiedad, deudas de mantenimiento y tal vez con alguien todavía esté viviendo la propiedad.

Se dice que una propiedad ha sido reposeída por el banco - mejor conocida en inglés como un Real Estate Owned (REO) - cuando el día de la subasta, al no existir algún comprador interesados en licitar o presentar una oferta de compra por una propiedad en específico, el representante del banco, presenta su oferta de compra y el título de la propiedad pasa a manos del banco que tiene la hipoteca.

Por eso, el comprar una propiedad que ha sido reposeída por algún banco, le ofrece a usted beneficios tales como seguridad y paz mental de que usted está adquiriendo una propiedad con un título limpio; o sea que no tiene cargas y gravámenes. Algunos de éstos beneficios son:

1. Usted tiene derecho a inspeccionar la propiedad antes de presentar su oferta al banco, aunque la propiedad sea entregada en “as is condition”.

2. Usted se sentirá más seguro de que no encontrará sorpresas y pagos de deudas adicionales, porque el banco, antes de pasar la propiedad a nombre del banco, ya se encargó de pagarlas por usted para que usted reciba un título limpio.

3. Usted no tiene que pagar en efectivo. El banco puede ofrecerle alternativas de financiamiento en los términos que el banco y usted seleccionen como los más convenientes para usted.

A REO (Real Estate Owned) is a property that goes back to the mortgage company after an unsuccessful foreclosure auction. Most foreclosure auctions do not even result in bids.

Why buy a property from the bank?

In order to bid at a foreclosure action, you must pay in cash (you must have a cashiers check in your hand for the full amount of your bid).

If you win the bid, you receive the property in “as is” condition, which may have a person or a family still living in the property. There may also be other liens in the property such as tax, liens, HOA Dues which may be a risk for you as an investor.

On the other hand, if you purchase a bank owned property it will be easier for you. Some of the benefits are:

1) You have the choice to make a property inspection before making a decision

2) The bank pays off any pending homeowners association dues and removes tax liens, this making it less stressful for you.

3) When you finance through a mortgage bank you will receive a title insurance policy.

4) You don’t need to pay cash… you can finance the property through a mortgage loan where you will received financing alternatives and terms that are the best for you.
